DOHR Board of Appeals Court Reporter

Long-term, Part-time Opportunity (up to 7 days/month)

Contractor will be the primary in-person Court Reporter for the office and the back-up virtual Court Reporter.

Purpose: The Court Reporter is responsible for producing a complete accurate, and secure transcript of DOHR Board of Appeal (BOA). The Court Reporter has a critical role in legal proceedings, which require an exact record of what occurred.

Summary: Provides court reporting services for Board of Appeals hearings; transcribes copies per request. The hearings will be in-person (Davidson County) or virtual (Microsoft Teams). Est. duration of hearings is 4 hours; however, they could run up to 8 hours in a day and could even go into a second day. DOHR will not supply equipment, equipment must be supplied by the court reporter.

Read back portions of events or legal proceedings upon request.
Review notes they have taken, including the spelling of names and technical terminology.
Transcribe during the scheduled hearing; remarks on objections, and exceptions to ruling, court ruling closing argument, etc.
Furnish a transcript of the reported evidence or other proceedings per requested and the cost of those will be covered in the hourly rate paid to the court reporter.

About the Board of Appeals: The Tennessee Excellence, Accountability, and Management (T.E.A.M) Act, Tennessee Code Annotated § 8-30-108, establishes the Board of Appeals. Under the Act, a preferred service employee who has completed the required probationary period may file an appeal regarding the application of a law, rule, or policy by an agency to the following employment actions: dismissal, demotion, or suspension.

There are three (3) steps of the appeal process for preferred service employees. Step I include an informal discussion between the employee (complainant) and the agencys appointing authority or designee. Step II includes a document review and decision by the Commissioner of the Department of Human Resources. Step III, the final step of the appeals process, is a hearing before the Board of Appeals.

The Board of Appeals has exclusive jurisdiction to hear matters at Step III brought by either the employee or agency. At Step III, the Board conducts proceedings in accordance with the Uniform Administrative Procedures Act, with certain modifications outlined in Tennessee Code Annotated § 8-30-318. An Administrative Law Judge assists with the hearing but does not make a recommendation for a final order. The Board must render a decision on the complaint within 120 days after the date of filing. An extension, not to extend beyond 140 calendar days, may be granted in extraordinary circumstances with the agreement of both parties.

The Board is administratively attached to the Department of Human Resources, which works closely with the Administrative Procedures Division in scheduling the hearings and making logistical arrangements.

The BOA schedule for the rest of the year is attached to this requisition. These will be the possible days that this contractor could work. Not all of these dates will be scheduled as some cases are resolved without the need for a hearing.
