The modification of North Dakotas current high risk pool, N.D.C.C. ch. 26.1-08 & N.D. Admin. Code ch. 45-06-02.1, (known as the Comprehensive Health Association of North Dakota or “CHAND”; hereinafter “CHAND”) to allow a greater number of high risk North Dakotans to obtain their health insurance from CHAND, along with an analysis of the corresponding insurer assessments necessary for CHAND to successfully operate with an increased high risk membership. Analysis of how to appropriately define who is considered to be “high-risk” and therefore eligible to obtain health insurance from CHAND. Analysis to determine feasibility and desirability of amending certain CHAND plan benefits and caps on certain benefits. Analysis of the amount of federal tax credit pass-through dollars the State would be expected to receive with implementation of this program. Suggestions for alternative funding sources, other than state legislative appropriation. Analyze administrative/operational needs and solutions to carry out each suggested option. 2. Same analysis as option no. 1 above, but analyze the items to modify CHAND into an invisible high risk pool where high risk North Dakotans can obtain their health insurance. 3. Reinsurance waiver - Creation of an invisible high risk pool independent of CHAND. Analysis of how to appropriately define who is considered to be “high-risk” and therefore placed into the invisible high risk pool. Analysis of the amount of money the state of North Dakota would have to legislatively appropriate and/or the amount insurance companies selling health insurance plans in North Dakota would have to be assessed, based on each companys share of the North Dakota individual health insurance market, for the invisible high risk pool to successfully operate. Analysis of the amount of federal tax credit passthrough dollars the State would be expected to receive with implementation of this program. Suggestions for alternative funding sources, other than state legislative appropriation. analyze North Dakotas health insurance market to the best of its ability and deliver information to the State to facilitate the States ability to provide a federal 1332 waiver application that includes: 1. An actuarial analysis and certification to support the States finding that the waiver complies with the coverage, comprehensiveness, and affordability requirements in each year of the waiver. 2. An economic analysis to support the States finding that the waiver will not increase the federal deficit over the five-year waiver period or in total over the ten-year budget period. 3. The data and assumptions that the State relied upon to determine the effect of the waiver on coverage, comprehensiveness, affordability and deficit neutrality requirements. a. The actuarial and economic analyses must compare coverage, comprehensiveness, affordability and net Federal spending and revenues under the waiver to those measures absent the waiver (the baseline) for each year of the waiver. b. The deficit analysis should show yearly changes in the federal deficit (that is, revenues less spending) due to the waiver. It should include a description of all costs associated with the program, including federal administrative costs, foregone tax collections, and any other costs that the federal government might incur.
