The required audit function is to express opinions on the fairness of the Workforce Safety and Insurance financial statements, and to determine the Workforce Safety and Insurance compliance with applicable state and federal laws and regulations. The request for proposal (RFP 117-19- 002) and the actual proposal from CONTRACTOR are incorporated into this contract by reference. In the event of conflict between this contract and the actual proposal from CONTRACTOR, this contract governs the matter. Workforce Safety and Insurance retains primary responsibility for properly recording transactions in the records, and for preparing reliable financial statements. Risk Management The contractor will take appropriate measures to ensure the safety of its employees, state employees, the public, and property. The contractor must identify any potential risks, issues and problems associated with the project and identify ways to mitigate those potential risks. Contract Term, Schedule and Deliverables 1. Contract Term Contract Term: The State intends to enter into a contract with an effective date beginning June 1, 2019 and ending after report presentations. Extension Option: There will be no contract extensions. Renewal Option: This contract will not renew. 2. Contract Deliverables and Schedule Contract Deliverables: The State has identified the following deliverables which are significant work products or milestones in the project. The State requires these deliverables to be addressed in the Contract Schedule, as a minimum. The contractor shall develop a schedule for accomplishing the Scope of Work, including these specific deliverables. The final schedule shall be agreed upon between the State and the successful offeror and incorporated into the contract QUALIFICATIONS AND EXPERIENCE A. Minimum Qualifications Offerors must have the following minimum qualifications in order to be considered for contract award: 1. The contractor must have the statutory authority to conduct audits in North Dakota as specified by N.D.C.C Chapter 43-02.2. Further the audits are required to be planned, supervised and most of the work done by Certified Public Accountants allowed to practice accounting under N.D.C.C Chapter 43-02.2. 2. The contractors most recent peer review or system of quality control review report must have received a peer review rating of pass. 3. The auditors must be independent in accordance with: a) AICPA standards, and; b) Government Auditing Standards, issued by the Comptroller General of the United States. 4. Auditor team members must meet the continuing professional education requirements of Government Auditing Standards. At the time specified by the Proposal Receipt Deadline, the offeror must have and keep current any professional licenses and permits required by federal, state, and local laws for performance of this contract. Offerors that do not possess required permits and licenses at the time proposals are due will be determined non-responsive and rejected B.
