The CUNY Academic Commons website is built on the WordPress, BuddyPress, and MediaWiki platforms and prospective bidders must be knowledgeable and proficient in these programs. A. Background. The college or department named in this purchase order (“College”) is a constituent unit of The City University of New York (“CUNY”). The vendor or supplier named on page 1 of this purchase order shall hereafter be referred to as “Contractor”. This Purchase Order is subject to the New York Education Law Section 6218 and State Finance Law Articles 9 and 11. The agreement that is being established by this Purchase Order is comprised of and governed by the following (collectively, "Contract"): (a) these Purchase Order Terms and Conditions, (b) New York State Appendix A, Standard Clauses for all New York State Contracts, as it may be amended, modified, or supplemented from time to time (“Appendix A”), which is incorporated herein (a current copy of which is available upon request if not attached), (c) the specifications set forth on the first page of or attached to this Purchase Order (“Specifications”), (d) any related invitation for bid or other solicitation document issued by CUNY (if any, “IFB”), (e) New York State Appendix B, excluding Section 62, version May 2015, which is incorporated herein by reference and shall supersede all Contractor and third-party-provided software license terms and conditions, and (f) any related bid submission, proposal, quote or the like from Contractor (if any, “Bid Submission”). The term "State" in Appendix A and Appendix B includes the State of New York and CUNY, which is a "contracting agency" and "State agency" for purposes of Appendix A. Defined terms may be used herein before being defined. IFB Terms and Conditions 13. Unless otherwise specified in the Specifications, Bidder shallmeet and comply with the following requirements; failure to do so is grounds for rejection of your Bid Submission and/or grounds for a determination of non-responsiveness. (a) Bidder shall have been in the relevant industry (as determined by CUNY) for a minimum of one (1) year as of the Bid Submission Deadline. (b) Bidder shall have satisfactorily completed within the two (2) years preceding the Bid Submission Deadline at least three (3) contracts of similar size, scope, complexity, and nature of the goods and/or services hereunder (“Similar Contracts”). 14. A Bidder may withdraw its Bid Submission at any time before the Bid Submission Deadline; each Bid Submission is binding and 15. The College or department named in this IFB is a constituent unit of CUNY. This IFB is subject to New York State Education Law §6218, State Finance Law Article 11, State Finance Law §§139-j and 139-k, Public Officers Law Article 6, other applicable law, and CUNY policies. 16. CUNY will review the Bid Submissions and award the Contract for the goods and/or services described herein to the Bidder who is both responsive and responsible (as these two terms are defined by New York State law) and offers the lowest Bid Price, unless the IFB specifies otherwise.
